3. How We Use Your Information
We use the information described above for the following purposes:
- To respond to your inquiry and communicate with you about products or services;
- To evaluate and manage a potential or existing business relationship, including creating and managing a record in our customer relationship management (CRM) system;
- To identify, evaluate, and coordinate Solutions on your organization's behalf, including sharing your business contact information with select Technology Services Distributors (TSDs) and their Provider networks as described in Section 7;
- To send you marketing communications, but only where you have given consent, and always with the ability to opt out;
- To contact you by text message or automated/prerecorded call, but only where you have given the specific consent described in Section 6 below;
- To detect and prevent spam, fraud, and abuse of our contact form;
- To comply with legal obligations and enforce our agreements;
- To improve our website and services, including understanding which marketing channels are effective.
4. Legal Bases for Processing (GDPR)
If you are located in the European Economic Area, United Kingdom, or another jurisdiction with similar requirements, we rely on the following legal bases:
- Consent — for marketing communications, SMS/text messaging, and any cookies or similar technologies that require consent.
- Legitimate interests — to respond to inquiries, maintain business records, and prevent fraud or abuse, balanced against your rights and interests.
- Performance of a contract or steps toward entering a contract — where your inquiry relates to a potential business engagement with us.
- Legal obligation — where processing is necessary to comply with law.
5. How Long We Keep Your Information
We retain personal information collected through our contact form for as long as necessary to respond to your inquiry, maintain our business records, and comply with legal, accounting, or reporting requirements. As a general practice, inquiry records are retained for 0 to 3 years typically from the date of your last contact with us, or up to 7 to 10 years after key milestones for regulated and legal requirements, unless you request earlier deletion or a longer period is required by law.
6. Marketing, Calls, and Text Messages (TCPA & CAN-SPAM)
We only send marketing emails, marketing text messages, or place autodialed or prerecorded marketing/informational calls to you if you have given your prior consent through our contact form or another lawful method.
- Text messages: By checking the applicable consent box, you agree to receive text messages from us at the phone number you provide, which may be sent using an automatic telephone dialing system. Consent to receive text messages is not a condition of purchasing any goods or services. Message and data rates may apply. Reply STOP to opt out at any time, or contact us using the details in Section 1.
- Marketing emails: Every marketing email we send includes a clear and conspicuous way to unsubscribe. We honor unsubscribe requests promptly and in any event within the timeframe required by the CAN-SPAM Act. We do not use deceptive subject lines or falsified header information, and our marketing emails identify us as the sender and include a valid physical postal address.
- Non-marketing communications: We may contact you by phone, email, or text for non-marketing purposes directly related to your inquiry (for example, to answer a question you submitted) without requiring the same marketing consent, consistent with applicable law.
7. How We Share Information
We do not sell your personal information. Because of the nature of our business as a Solutions agent and sub-agent, we share limited business contact information with the following categories of third parties in order to fulfill your request:
- Technology Services Distributors (TSDs), also known as master agents or agencies, through which we access a broad network of Providers on your behalf;
- Providers: The specific Provider(s) ultimately identified and evaluated as a fit for your organization's needs, for purposes of discovery calls and proposal presentations;
- Service providers who help us operate our business, such as our email delivery provider, customer relationship management (CRM) platform, and website/security infrastructure providers (for example, Cloudflare - Privacy Policy), under contractual obligations to protect your information;
- Professional advisors, such as legal or accounting professionals, where necessary;
- Law enforcement or regulators, where required by law or to protect our rights, property, or safety, or that of others;
- A successor entity in connection with a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our business assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding.
Sharing your business contact information with the TSD and identified Provider(s) is necessary to perform the specific service you have requested — namely, identifying and evaluating Solutions for your organization. If you choose to move forward with a Provider, you will contract and pay that Provider directly; we are not a party to that contract. We do not share your information with TSDs or Providers for their independent marketing purposes; the sharing is scoped to fulfilling your inquiry. For information about how we are compensated in connection with these referrals, see our Terms of Use & Service Engagement Terms.
8. International Data Transfers
Our systems are operated from the United States. If you are located outside of this jurisdiction, your information may be transferred to, stored, and processed in a country with different data protection laws than your own. Where required, we take steps to ensure appropriate safeguards are in place for such transfers.
9. Your Privacy Rights
Depending on your location, you may have the following rights regarding your personal information:
- Right to access — request a copy of the personal information we hold about you;
- Right to rectification/correction — request that we correct inaccurate or incomplete information;
- Right to erasure/deletion — request that we delete your personal information, subject to certain legal exceptions;
- Right to restrict or object to processing — request that we limit how we use your information, or object to certain processing, including direct marketing;
- Right to data portability — request a copy of your information in a portable format, where applicable;
- Right to withdraw consent — withdraw consent at any time for processing based on consent, such as marketing or text messaging;
- Right to lodge a complaint — with your local data protection authority.
How to Exercise Your Rights
To submit a request to access, correct, or delete your personal information, contact us at [email protected] with the subject line "Privacy Request." We will verify your identity before fulfilling your request and will respond within 45 days, or sooner where required by applicable law. There is no charge for making a request, except where permitted by law for excessive or repeated requests.
9a. California Privacy Rights (CCPA/CPRA)
If you are a California resident, this section supplements Section 9 above and describes rights specific to the California Consumer Privacy Act, as amended (CCPA). These rights apply to you as an individual, even where your communications with us occur in a business-to-business context on behalf of your employer or organization.
Right to Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you services;
- Charge different prices or rates, including through denying discounts or imposing penalties;
- Provide a different level or quality of service; or
- Suggest that you may receive a different price, rate, or level or quality of service.
Authorized Agents
You may designate an authorized agent to submit a CCPA request on your behalf. To do so, the agent must provide us with signed written permission from you authorizing the agent to act on your behalf. We may still require you to verify your own identity directly with us, or confirm directly with us that you provided the agent this authorization.
Verifiable Requests and Limits
To protect your information, we will verify your identity before fulfilling a request, which may require you to provide your name, email address, and details of your prior contact with us. You may submit a verifiable request for access or data portability up to twice within a 12-month period.
How to Submit a CCPA Request
Submit requests to [email protected] with the subject line "CCPA Request," or by calling +1 (561) 325-6090.
10. Data Security and Compliance
We use reasonable administrative, technical, and physical safeguards designed to protect your personal information, including encrypted transmission (HTTPS/TLS), access controls, and bot/abuse detection on our contact form.
Our production infrastructure is hosted primarily on Cloudflare and Oracle Cloud Infrastructure (OCI), among others. Cloudflare and OCI each maintain independent, third-party compliance attestations and certifications for their respective applicable services and commercial regions — including widely recognized frameworks such as SOC 2 Type II and ISO/IEC 27001, among others. These attestations apply to the underlying infrastructure and services these providers operate, not to our company's own application or data-handling practices, which are described in this Privacy Policy. For the current, complete list of certifications and attestations, and the specific services and regions they cover, see Cloudflare's compliance resources and Oracle Cloud compliance page.
Security and compliance in the cloud operate under a shared-responsibility model. Cloudflare and OCI are responsible for the underlying physical facilities, hardware, core cloud infrastructure, and portions of platform operations. We are responsible for the guest operating system, applications, identities, data, network configuration, logging, and operational processes running on top of that infrastructure, which are not certified by Cloudflare or OCI on our behalf. Our own security practices include encryption in transit and at rest, OS hardening and regular patching, TLS configuration hardening, identity and access management with multi-factor authentication, zero-trust network access controls, network segmentation, DDoS mitigation, secrets management, vulnerability management, backups, monitoring, incident response, application security practices, and supplier and personnel security policies.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Children's Privacy
Our website and services are directed at businesses and adults and are not intended for children. We do not knowingly collect personal information from children under 16. If we learn that we have collected such information, we will delete it promptly.
12. Cookies and Tracking Technologies
Please see our Cookie Notice for details about cookies and similar technologies used on this website.
13. Relationship to Our Terms of Use
This Privacy Policy addresses how we handle personal information. Separately, our Terms of Use & Service Engagement Terms describe the nature of our Solutions, including how we are compensated in connection with introductions to Technology Services Distributors and their Provider networks. Both documents apply to your use of this website and your submission of our contact form.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the revised policy on this page with an updated effective date. Material changes will be communicated as required by applicable law.
